Terms of Use

Bulk Dialer is an offline CRM and auto-dialing utility provided by **Staksoft**. The software allows users to build local calling campaigns, import sheet leads (CSV/Excel), automate outbound dialing queues with customizable buffer delays, template and broadcast WhatsApp follow-ups, and log outcomes locally.

As an offline-first app, all calling operations are processed locally through your device's telephony system or the official WhatsApp application installed on your phone.

You agree to use Bulk Dialer only for lawful, professional business communication. In utilizing the application, you represent and warrant that:

• You have obtained prior, active consent (opt-in) from all contacts uploaded into your campaigns.
• You will not upload numbers registered on national or regional "Do Not Call" registries.
• You will not use the dialer for unsolicited advertising, phone harassment, or voice-phishing (vishing).
• You will not configure the app for automated robocalling or plays of pre-recorded audio messages.

Because telephony laws vary by region, you are solely responsible for ensuring your outreach compliance. You agree to strictly adhere to all applicable local and international telecommunication rules, including but not limited to:

• India: TRAI (Telecom Regulatory Authority of India) guidelines, DND (Do Not Disturb) checking registry rules, and commercial telemarketing hours.
• United States: TCPA (Telephone Consumer Protection Act) regulations, federal/state DNC lists, and outbound call timing restrictions.
• Europe: GDPR (General Data Protection Regulation) laws governing contact details storage and right-to-be-forgotten requests.

Bulk Dialer provides templates and queue workflows that interface with the official WhatsApp client. Please read the following disclosures carefully:

• Third-Party Independence: Bulk Dialer is 100% independent. It is not affiliated with, sponsored by, or endorsed by WhatsApp Inc. or Meta Platforms, Inc.
• Terms of Service: Your message transmissions are governed by WhatsApp's official Terms of Service.
• Limit Warning & Suspension Liability: Sending bulk templates or promotional material to unsaved numbers can lead to account limitations or permanent bans. Bulk Dialer includes safe-limit warning indicators, but Staksoft accepts no responsibility or liability for WhatsApp account suspensions resulting from your messaging activities.

Bulk Dialer values data minimization:

All call histories, customer notes, templates, and lead records are saved locally in the app's sandboxed Hive database. Staksoft does not host cloud backups, synchronize profiles, or retain copies of your campaigns.

⚠️ IMPORTANT: Deleting the Bulk Dialer application or executing a "Wipe All Data" command permanently purges your records. Staksoft is unable to recover or restore lost campaigns under any circumstances.

Bulk Dialer is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied.

Staksoft does not guarantee that the dialer will operate uninterrupted, error-free, or compatible with all dual-SIM hardware configs. To the maximum extent permitted by law, Staksoft is not liable for indirect, incidental, or consequential damages, including loss of client leads, data corruption, dropped calls, telecommunication overages/bills, or business revenue interruptions.

The Bulk Dialer application (including source code, compiled binaries, branding assets, custom widgets, and logo design) is the exclusive intellectual property of Staksoft.

We reserve the right to modify, suspend, or discontinue any feature inside the application at any time. We may also update these Terms of Use periodically, with updates active upon page publication.

These Terms of Use shall be governed by, construed, and enforced in accordance with the laws of India, without regard to conflict of law principles. Any dispute arising from these terms shall be subject to the exclusive jurisdiction of the courts located in Delhi, India.
